What is Purpose Code P0029?

The P0029 purpose code is used when a non-government body in India receives a capital transfer from abroad. A capital transfer is a one-off payment that funds assets or covers a major loss, with nothing given back in return. The RBI description lists guarantee payments, investment grants from non-government sources and exceptionally large non-life insurance claims. It is a capital account code. A grant for a school building is a capital transfer; money for salaries is a current transfer. The P0029 purpose code is the non-government version of P0028, for companies, NGOs, trusts and societies.

When to use P0029 Purpose Code?

This Purpose Code should be used only where the transaction fits its defined regulatory scope. Here's when you should and shouldn't use this code:

You should use this code when:

  • Investment grants from foreign foundations - Grants from a foreign trust, foundation or company to build or buy assets, such as a hospital wing, a lab or equipment.
  • Guarantee payments - Money paid by a foreign guarantor when a guarantee given for an Indian company's loan or contract is called.
  • Large insurance claims after a disaster - Exceptionally large non-life claims paid by a foreign insurer or reinsurer, for example after a flood destroys a factory.

Do not use this code when:

  • The receiver is a government department or the grant comes from a foreign government on government account (use P0028 instead).
  • The receipt is an ordinary, routine non-life insurance claim (use P0607 instead).
  • A donation to a charity pays for current spending, not assets (use P1303 instead).
  • The foreign party gets shares in return for the money (use P0006 instead).

Importance of Purpose Codes

RBI purpose codes are mandatory under FEMA to classify the nature of cross-border transactions entering or leaving India. They allow banks and regulators to accurately track foreign exchange flows and apply the correct regulatory, tax, and reporting treatment.

For individuals, businesses and institutions, correct purpose code usage:

  • Ensures transactions are classified correctly under FEMA.
  • Enables accurate reporting to the RBI and other regulators.
  • Reduces delays caused by compliance checks or misclassification.
  • Supports clean audit trails and tax reconciliation.

Bottom-line:

Using the correct purpose code helps ensure smooth processing, regulatory compliance, and faster credit of funds.

How to apply Purpose Code P0029?

  1. Select "P0029 – Capital transfer receipts, Non-government" when the bank asks for the purpose of the inward remittance.
  2. Share the grant agreement, guarantee invocation or insurance settlement letter.
  3. Give a FEMA declaration that the money is a one-off capital transfer and how it will be used.
  4. The bank checks the documents and credits the account.

Additional Notes:

  • NGOs, trusts and societies need FCRA registration or prior permission to accept foreign grants, and must first receive them in their FCRA account at SBI, New Delhi Main Branch.
  • Only exceptionally large claims, such as calamity claims, count as capital transfers. Routine claims stay under insurance codes.
  • Tax on grants depends on the facts, so check with your CA.

Common mistakes to avoid

  • Using a generic or incorrect purpose code instead of the exact RBI-prescribed purpose code can lead to misclassification of the transaction under FEMA and trigger additional compliance checks by the bank.
  • Mismatch between purpose code, invoice, and remittance narration may place the transaction on hold until clarification is provided.
  • Submitting unclear or incomplete supporting documents that do not clearly describe the nature of the transaction often result in delays, as banks rely on documentation to validate FEMA compliance.
  • Missing mandatory PAN or incomplete KYC documentation can prevent banks from releasing funds until verification is completed.
  • Using service-related purpose codes for non-service transactions like capital receipts, investments, gifts, or refunds can result in incorrect regulatory treatment and potential reporting issues.
  • Assuming small or recurring transactions do not require accuracy and repeated misclassification can attract regulatory scrutiny over time.
